NourishedBaby collects and processes sensitive health-related data, including pregnancy information and dietary intake. We treat this category of data with heightened care and do not use it for advertising, sell it to third parties, or share it beyond what is described in this policy.

1. Information We Collect

When you use NourishedBaby, we may collect the following types of information:

• Account Information: Your display name and email address when you create an account or sign up for our waitlist.
• Health and Pregnancy Data: Pregnancy week, trimester, due date, and other pregnancy-related information you voluntarily provide. This is sensitive health data and is treated accordingly.
• Nutrition and Meal Data: Meal logs, nutrient intake records, water intake, and dietary patterns you enter into the App.
• Supplement Information: Prenatal vitamin brand, supplement details, and daily supplement logs you choose to enter.
• Photos: Images of meals or food items you submit for AI-based nutritional analysis. Photos submitted for analysis are sent to a third-party AI provider for processing and are not stored beyond what is necessary to complete the analysis.
• Voice Recordings: Audio input you submit via the voice logging feature. Voice recordings are processed to extract meal information and are not stored beyond what is necessary to complete the transcription.
• Notification Preferences: Your notification settings and, where applicable, your device push notification token.
• Device Information: Device type, operating system, and app version for troubleshooting and improving the experience.
• Usage Data: How you interact with the App, such as features used and session duration, to help us improve the product.

2. How We Use Your Information

We use your information to:

• Provide personalized nutrition tracking, weekly progress scores, and daily insights based on your pregnancy stage and dietary data;
• Process meal photos and voice recordings through AI analysis to estimate nutritional content;
• Auto-log prenatal supplement contributions to your daily nutrient totals;
• Send you relevant emails if you have opted into our waitlist or newsletter;
• Improve the App experience and fix bugs;
• Generate anonymized, aggregate analytics to understand usage patterns. We never sell individual data.

3. Legal Basis for Processing (GDPR)

If you are located in the European Economic Area (EEA) or United Kingdom, we are required to identify the legal basis on which we process your personal data. We rely on the following:

• Consent: For the collection and processing of sensitive health data, including pregnancy information, dietary data, and supplement records. You may withdraw your consent at any time by deleting your account.
• Performance of a contract: For account creation and the delivery of core App features.
• Legitimate interests: For anonymized analytics and product improvement, where those interests are not overridden by your privacy rights.
• Legal obligation: Where we are required to process or retain data by applicable law.

4. AI Processing and Third-Party Service Providers

When you use photo or voice logging features, your input is transmitted to a third-party AI provider for processing. This is necessary to analyze the nutritional content of your meal. We do not sell your data to AI providers, and they are contractually prohibited from using your data for any purpose other than completing the analysis.

We also work with other trusted third-party service providers to operate the App, including:

• Cloud hosting and infrastructure providers;
• Email delivery platforms;
• Anonymized analytics tools; and
• Nutritional databases, including the USDA FoodData Central database.

All third-party providers are selected carefully and are contractually obligated to protect your data, process it only for the purposes we specify, and comply with applicable privacy laws.

5. Data Sharing

We do not sell, rent, or trade your personal information. Outside of the service providers described in Section 4, we may share your data only in the following circumstances:

• Legal requirements: If required by law, regulation, court order, or government request.
• Protection of rights: To enforce our Terms of Service, protect the safety of our users, or defend against legal claims.
• Business transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred as part of that transaction. We will notify you before your data is transferred and becomes subject to a different privacy policy.

6. International Data Transfers

NourishedBaby operates globally, and your data may be processed or stored in countries other than where you reside, including the United States. These countries may have different data protection laws than your own.

Where we transfer personal data from the EEA or United Kingdom to countries not recognized as providing an adequate level of protection, we implement appropriate safeguards such as Standard Contractual Clauses approved by the European Commission. Your data is stored securely using industry-standard encryption in transit and at rest. We apply technical and organizational measures appropriate to the sensitivity of the data we hold, including the sensitive health data described in this policy.

We retain your personal data for as long as your account is active or as necessary to provide our services. If you delete your account:

• Your personal data will be deleted or anonymized within 30 days of your request;
• Anonymized, aggregate analytics data that cannot be linked back to you may be retained; and
• Certain data may be retained longer where required by law or for legitimate legal defense purposes.

You can request deletion of your data at any time by contacting us at the address in Section 13 or through the account deletion option in the App settings.

8. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

All users:

• Access the personal data we hold about you;
• Request correction of inaccurate data;
• Request deletion of your data;
• Opt out of marketing communications at any time; and
• Request a portable copy of your data in a machine-readable format.

EEA and UK users (GDPR):

• Withdraw consent at any time where processing is based on consent, without affecting the lawfulness of prior processing;
• Object to processing based on legitimate interests;
• Request restriction of processing in certain circumstances; and
• Lodge a complaint with your national data protection supervisory authority.

California users (CCPA):

• Know what personal information is collected about you and how it is used;
• Know that NourishedBaby does not sell your personal information; and
• Not be discriminated against for exercising any of your privacy rights.

9. Advertising and Tracking Technologies

NourishedBaby does not use advertising identifiers (such as Apple's IDFA) and does not track users across other companies' apps or websites for advertising purposes. The App does not display third-party advertisements.

Our website may use cookies and similar technologies to improve your browsing experience and analyze site traffic. Cookies are small text files stored on your device. We use session cookies (which expire when you close your browser) and persistent cookies (which remain until deleted). You can manage or disable cookies through your browser settings, though some features of the website may not function correctly if cookies are disabled.

10. Children's Privacy

NourishedBaby is intended for users aged 18 and over. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided us with personal data, please contact us and we will promptly delete it. This minimum age is consistent with our Terms of Service.

11. Third-Party Links

Our App and website may contain links to third-party services or websites. We are not responsible for the privacy practices of those services and this Privacy Policy does not apply to them. We encourage you to review the privacy policies of any third-party services you access through the App.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top of this document and notify you of significant changes by posting a notice in the App or sending an email to the address associated with your account. Your continued use of NourishedBaby after changes take effect constitutes acceptance of the updated policy. If you do not agree to the updated policy, you should stop using the App and delete your account.
