Terms of Service

1. Agreement to Terms

By downloading, installing, or using the NourishedBaby mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and NourishedBaby.

2. Eligibility

To use the App, you must:

• Be at least 18 years of age;
• Have the legal capacity to enter into a binding agreement; and
• Not be prohibited from using the App under applicable law.

The App is designed for use during pregnancy and the postpartum period. Users outside these circumstances may use the App at their own discretion but should be aware that content and recommendations are tailored to pregnant and postpartum individuals.

3. Use of the App

NourishedBaby is a nutritional tracking tool designed to help users monitor their dietary intake during pregnancy and the postpartum period. You are solely responsible for:

• The accuracy, completeness, and appropriateness of all data you enter into the App;
• All decisions made based on information provided by the App; and
• Ensuring that use of the App is appropriate for your individual health circumstances.

4. No Medical Advice

The content provided through the App, including nutrient tracking data, progress scores, meal suggestions, and AI-generated daily insights, is for informational and general wellness purposes only. It is not medical advice and is not a substitute for professional medical advice, diagnosis, or treatment.

You should always consult a qualified healthcare provider, such as your obstetrician, midwife, or registered dietitian, before making changes to your diet, supplement regimen, or health practices during pregnancy. Do not disregard or delay seeking professional medical advice because of anything you read or receive through the App.

The App does not account for individual medical conditions, including but not limited to:

• Gestational diabetes or insulin resistance;
• Hyperemesis gravidarum or severe nausea;
• Food allergies or intolerances;
• Pre-existing nutritional deficiencies; or
• Any other condition requiring individualized medical management.

If you are experiencing a medical emergency, call your local emergency services immediately. Do not rely on the App in an emergency situation.

5. Nutritional Data Accuracy

Nutrient values displayed in the App are sourced from established nutritional databases, including the USDA FoodData Central database, and from information you provide about your prenatal supplements. While we strive for accuracy, we cannot guarantee that:

• Nutrient values reflect every food brand, preparation method, or regional variation;
• AI-generated analyses of meals from photos, voice input, or text descriptions are exact measurements; or
• Database values are current or complete for all foods.

AI-generated meal analyses and nutritional estimates are approximations only and should not be treated as clinical measurements or used as the sole basis for medical or dietary decisions.

6. AI-Generated Content

The App uses artificial intelligence to generate personalized daily insights, meal analyses, and dietary suggestions (collectively, "AI Content"). You acknowledge and agree that:

• AI Content is generated for general informational purposes only and does not constitute personalized medical or dietary advice;
• AI Content may not be appropriate for every user's individual health situation;
• AI systems can produce errors or unexpected outputs; and
• You should exercise your own judgement and consult a healthcare provider before acting on any AI Content.

7. User Accounts

You are responsible for:

• Maintaining the security and confidentiality of your account credentials;
• All activity that occurs under your account; and
• Notifying us promptly if you become aware of any unauthorized access to your account.

You may not share your account credentials with any other person. Each account is for a single individual user only.

8. Acceptable Use

You agree not to use the App to:

• Facilitate or encourage disordered eating behaviors, including but not limited to extreme caloric restriction, bingeing, or purging;
• Enter false or misleading data with the intent to generate inaccurate nutritional assessments;
• Reverse-engineer, decompile, or attempt to extract the source code of the App;
• Violate any applicable law or regulation; or
• Interfere with or disrupt the integrity or performance of the App or its underlying systems.

9. In-App Purchases and Subscriptions

The App may offer a free tier and optional paid subscription plans ("Premium"). If you choose to purchase a subscription:

• Subscriptions are billed on a recurring basis (monthly or annual) at the rate displayed at the time of purchase;
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period;
• You can manage and cancel your subscription at any time through your Apple App Store or Google Play account settings;
• Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time unless required by applicable law; and
• All purchases are subject to the refund policies of Apple App Store or Google Play, as applicable.

All in-app purchases are processed by Apple (via the App Store) or Google (via Google Play), as applicable. By making a purchase, you agree to the payment terms of the applicable platform. NourishedBaby does not directly process or store your payment information.

10. Third-Party Services

The App integrates with third-party services and APIs, including AI providers and nutritional databases, to deliver its features. You acknowledge that:

• Third-party services are governed by their own terms of service and privacy policies;
• We are not responsible for the availability, accuracy, or conduct of any third-party service; and
• Interruptions or changes to third-party services may affect the functionality of the App without notice.

11. Intellectual Property

All content, design, software, branding, text, graphics, and other materials in the App are owned by or licensed to NourishedBaby and are protected by applicable intellectual property laws. You may not:

• Reproduce, distribute, or publicly display any part of the App without our prior written permission;
• Use our name, logo, or branding in any way that implies endorsement or affiliation without our consent; or
• Create derivative works based on the App or its content.

12. Data and Privacy

By using the App, you agree to the collection and use of your data as described in our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, store, use, and protect your personal and health-related information, including pregnancy week, due date, dietary intake, and supplement data. Please review the Privacy Policy carefully before using the App.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have:

• Violated these Terms;
• Engaged in fraudulent or harmful activity; or
• Created risk or potential legal exposure for NourishedBaby or its users.

You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination will continue to apply.

14. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, NourishedBaby disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• That the App will be uninterrupted, error-free, or secure; and
• That the information provided will be accurate, complete, or suitable for any particular individual.

15. Limitation of Liability

To the maximum extent permitted by applicable law, NourishedBaby and its founders, officers, employees, and agents shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of data, profits, or goodwill;
• Health outcomes or medical decisions made in reliance on information provided through the App; or
• Any damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Where liability cannot be excluded by law, our total liability to you for any claim arising out of or in connection with these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or USD $100, whichever is greater.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this document and notify you via email or an in-app notice. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Delaware in which NourishedBaby is registered, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be resolved through good-faith negotiation in the first instance. If a dispute cannot be resolved informally, it shall be submitted to the courts of competent jurisdiction in NourishedBaby's registered jurisdiction.
